Frequently Asked Questions About Family Law

Does a Prenuptial Agreement make a high asset divorce simple?
The answer is probably, but not certainly. “Prenups” still leave certain issues that need to be negotiated and finalized depending on the language in your agreement. For example, a Prenup may say that an asset is to be equally divided between the parties, but the parties may have a dispute as to the value of that asset, meaning we have to determine a value before we can execute the division (think value of real property, or value of a family business).  In those cases, we have a roadmap for the divorce, but we still have to navigate the way to the end.  Also, certain issues cannot be resolved with a prenuptial agreement, including custody, parenting time, and child support, so even with a rock solid Prenup, there may still be issues which have to be settled or brought before the court.
